As its last witness, the prosecution brought forward Millard Whited, lanky mountaineer neighbor of the Lindberghs at Hopewell. Dramatically he put his hand on Hauptmann's shoulder to identify him as the man he had seen lurking about he Lindbergh estate before the kidnaping. Mr. Fawcett asked him how, after two years, he could remember Hauptmann's face. Whited wrinkled his own uncouth countenance.
"Would you remember my face if you saw it somewhere?" he asked pleasantly.
"I certainly would," said Mr. Fawcett, and the spectators howled. [News Week, 10-27-34]

Whited Statement - 2/22/36 p.43 Q [Fisher]: You think this testimony was not in the record? You think these questions were not asked? A [Whited]: I cannot dispute your word. I said to the best of my knowledge I could not remember those questions being asked of me.
Q: Suppose they were asked, are the answers correct answers? Are they the answers you would give to it? You would tell us today about covering the State Police?
A: Listen, I think, Mr. Fisher, I think this; I think the best thing fro me to do is to keep quiet until Mr. What's - his - name gets back.

Hoffman] Now, there have been certain questions raised about the trial and about the case. All I have before me is one statement which you gave, which you singed on April 26, 1932, where you say you did not see anyone in the woods or in the vicinity of the Lindbergh home, where you say you did not have any information that will help the police at all. The next thing I have is a statement on October 6 where you, a man who back in April, 1932, said you did not see anyone, I find you over in New York picking out the man that you said you saw twice. And the next thing I have is the record at the Flemington trial where you again say you saw this man twice. And at one time it refers to any statement that you gave, and in connection wit hte statements you say you signed a statement and that those statements that you gave were true.

you people think condon was bagered, this guy was to. theres no dougt in my mind that hauptmann scouted the place out before march 1
